Terms of Use and GDPR / Privacy Notice

 

1. About our platform

These Terms of Use and GDPR / Privacy Notice (“Terms”) govern your use of the online platform (the “Platform”) that connects workers (“Talents”) and employers (“Employers”) for job opportunities, including seasonal and long‑term work in Europe and other destinations. 

By creating an account, accessing or using the Platform, you acknowledge that you have read, understood and agree to these Terms and to our processing of your personal data as described below. 

If you do not agree, you must not use the Platform.

 

2. Roles and scope of service

The Platform provides a searchable database of talent profiles which Employers can use to discover, contact and contract with Talents directly. 
The Platform itself is not a party to any employment or service contract between Talents and Employers; those contracts are concluded directly between the parties. 
The Platform may offer tools such as messaging, document exchange, and “Direct Contracts” features (e.g., milestones, payment protection) to facilitate agreements, but responsibility for the content and performance of any contract lies with the Talent and the Employer.

 

3. User accounts and eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts under applicable law to create an account.
Talents are responsible for ensuring that they meet all legal requirements to work in the destination country, including visas, work and residence permits, and recognition of qualifications. 
Employers are responsible for ensuring that they comply with all applicable immigration, labour, tax, social security and non‑discrimination laws when hiring Talents found via the Platform. 
You must provide accurate, complete and up‑to‑date information when registering and when updating your profile or company details.

  

4. Use of the Platform

When using the Platform, you agree to:

Use the Platform only for lawful purposes, including genuine recruitment and job‑search activities.
Not post, upload or transmit any content that is false, misleading, defamatory, discriminatory, abusive or otherwise unlawful.
Not use the Platform to exploit workers, evade labour standards, or bypass legal requirements for visas, work permits or social security. 
Not attempt to interfere with the security or proper functioning of the Platform (e.g., by hacking, scraping, or introducing malware).
Respect the privacy and confidentiality of other users’ data and communications, and use personal data obtained through the Platform only for legitimate recruitment or job‑search purposes, in compliance with GDPR and other applicable laws. 
We may suspend or terminate your account if you breach these Terms or if we reasonably suspect misuse or unlawful activity.

  

5. Profiles, content and direct contracts

Talents: Your profile is your storefront. You may add a headline, bio, skills, experience, location, availability, portfolio items and testimonials. You are solely responsible for the accuracy of this information and for obtaining any necessary permissions to share portfolio content, references and photos. 
Employers: You may create an employer profile, search Talents by role, skills, location and experience, and contact Talents directly to discuss roles and offers. 
Direct Contracts: Where available, the Platform may offer tools that help Talents and Employers formalize engagements (scope, milestones, deliverables, payment schedules, acceptance criteria, ownership, and dispute resolution). The content of these arrangements is decided by the Talent and Employer; the Platform does not guarantee performance or outcomes. 
You grant the Platform a non‑exclusive, worldwide, royalty‑free license to host, display and use the content you upload (profiles, logos, descriptions, portfolio items) for the purpose of operating and promoting the Platform, for as long as your content is published or as required by law.

 

6. Fees and payments (if applicable)

The Platform may charge fees to Employers and/or Talents for certain services (e.g., promotions, featured listings, payment tools, or other premium features). Any applicable fees and billing terms will be displayed clearly before you confirm a purchase or upgrade.
Where the Platform offers payment or escrow tools, it acts as a technical service provider, not as an employer, payroll provider or tax agent. You remain responsible for your own tax and social‑security obligations and for agreeing clear payment terms in your contracts.

 

7. Data protection and GDPR

The Platform acts as a “controller” of personal data for the purposes of the EU General Data Protection Regulation (GDPR) where it determines the purposes and means of processing your personal data to operate the marketplace. 

In some situations (for example where Employers export data into their own systems), Employers may become independent controllers of that data and must comply with their own GDPR obligations. 

7.1 Categories of personal data we process

Depending on whether you are a Talent or an Employer, and how you use the Platform, we may process the following categories of personal data:

Identification and contact data (name, surname, date of birth, nationality, email, phone number, address).
Account data (login details, role as Talent/Employer, language, preferences).
Profile and professional data (photo, headline, bio, skills, work history, education, qualifications, languages, references, testimonials, portfolio items, salary/rate expectations, availability).[2][1]
Employer data (company name, contact persons, company description, sector, locations, job briefs, hiring history). 
Documentation you provide (CVs, diplomas, certificates, licences, proof of qualifications, in some cases passport or ID data, health or criminal‑record certificates where legally required for specific roles – only where you voluntarily provide them or where required by law). 
Usage data (log data, device information, IP address, activity logs, support interactions, analytics).
We do not intentionally collect special categories of data (e.g., health, religion) except where you voluntarily provide documents required by law for specific roles or where needed to comply with legal obligations, in which case we apply additional safeguards.

7.2 Purposes and legal bases for processing

We process your personal data for the following purposes and on the following legal bases under GDPR: 

Operating the Platform and providing services (creating and maintaining your account, enabling profile search, messaging, direct contracts, support).
Legal bases: performance of a contract (Article 6(1)(b) GDPR) and legitimate interest to operate a secure and effective platform (Article 6(1)(f) GDPR).
Matching Talents and Employers and promoting profiles and roles (e.g., search results, featured profiles, talent pools, analytics). 
Legal bases: performance of a contract and legitimate interest in facilitating recruitment and job‑search.
Verifying eligibility and compliance (e.g., verification of identity, qualifications, right to work, fraud prevention, compliance with immigration and labour rules where appropriate). 
Legal bases: legal obligation (Article 6(1)(c) GDPR) and legitimate interest in ensuring trust and compliance.
Communicating with you (service emails, support, security notifications, changes to terms, and – where permitted – marketing communications about the Platform).
Legal bases: performance of a contract, legal obligation, and consent for certain marketing communications.
Improving and securing the Platform (analytics, statistics, troubleshooting, security monitoring).
Legal bases: legitimate interest in improving and protecting the Platform.
Where we rely on consent (for example for certain marketing emails or optional data fields), you can withdraw your consent at any time via your account settings or by contacting us, without affecting the lawfulness of processing before withdrawal.

7.3 Data sharing and recipients

We may share your data with:

Other users:
Talents: your profile, including selected personal and professional details, will be visible to Employers using the Platform to search for candidates. 
Employers: your employer profile, posted roles and company information will be visible to Talents searching for opportunities. 
Service providers (processors):
IT hosting, payment providers, communication tools, analytics, customer‑support systems and other vendors that process data on our behalf under data‑processing agreements that comply with GDPR. 
Authorities and legal recipients:
Where required to comply with immigration, labour, tax, social‑security or other legal obligations, or to respond to lawful requests from public authorities or courts, particularly in the context of international recruitment, visa processes and enforcement of worker protections. 
We do not sell your personal data.

7.4 International data transfers

Because the Platform connects Talents and Employers across countries, your data may be transferred to and accessed from countries outside the European Economic Area (EEA), including where Talents are recruited from third countries and Employers are based in the EU or vice versa. 

Where such transfers involve countries without an EU adequacy decision, we will implement appropriate safeguards such as Standard Contractual Clauses and additional technical and organizational measures as required by GDPR.

7.5 Data retention

We keep your personal data only for as long as necessary for the purposes described above:

Active accounts: for as long as your account remains active and for a reasonable period thereafter to manage potential claims, legal obligations and audits.
Closed accounts: we will delete or anonymize your data after a defined retention period, except where we must retain certain records (e.g., contracts, invoices, visa‑related documents) for legal or regulatory reasons. 
Logs and analytics data: for shorter, defined periods necessary for security, statistical analysis and service improvement.
Retention periods may vary depending on legal requirements in the relevant jurisdiction (e.g., employment, immigration, and tax rules).

7.6 Your GDPR rights

Under GDPR, you have the following rights, subject to conditions and exemptions: 

Right of access – to obtain confirmation whether we process your data and access to that data.
Right to rectification – to correct inaccurate or incomplete data.
Right to erasure (“right to be forgotten”) – to request deletion of your data in certain circumstances.
Right to restriction of processing – to limit processing under specific conditions.
Right to data portability – to receive your data in a structured, commonly used, machine‑readable format and transmit it to another controller.
Right to object – to object to processing based on our legitimate interests, including profiling; and to object at any time to processing for direct marketing.
Right not to be subject to a decision based solely on automated processing, including profiling, where it produces legal effects or similarly significant effects, unless conditions set by law are met.
To exercise your rights, contact us using the details in Section 10. We may need to verify your identity before responding.

You also have the right to lodge a complaint with your local data‑protection authority. For users in the EU/EEA, this is usually the supervisory authority in your place of habitual residence, place of work, or place of alleged infringement.

7.7 Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, accidental loss, destruction or damage, taking into account the state of the art, costs of implementation and the nature of the data. 

You are responsible for keeping your login credentials confidential and for promptly notifying us of any suspected unauthorized use of your account.

 

8. Users’ data protection responsibilities

Employers must handle personal documents and data received from Talents (e.g., CVs, diplomas, visa documents, references) in accordance with GDPR and applicable national privacy laws, limiting access to authorized personnel and retaining records only as legally permitted.[3][1]
Talents must respect the privacy of Employers and other Talents and use contact details and information obtained via the Platform only for legitimate recruitment or collaboration purposes.
Both parties should ensure secure storage and transmission of documents, avoid sharing passwords, and promptly report any suspected data breach involving Platform data.

 

9. Cookies and tracking technologies

The Platform may use cookies and similar technologies to:

Keep you logged in and provide core functionality.
Remember your preferences and improve your user experience.
Analyze usage and performance to improve the Platform.
Where required by law, we will obtain your consent before placing non‑essential cookies, and you can manage your preferences through your browser or our cookie banner.

 

10. Liability and disclaimers

The Platform is provided “as is” and “as available”. We do not guarantee that you will find a job, hire a worker, obtain a visa or successfully complete any engagement through the Platform. 
We do not guarantee the truthfulness, completeness or legality of user‑generated content (profiles, job briefs, testimonials, documents). Each user is responsible for performing their own due diligence, including verification of qualifications, rights to work, and employment conditions. 
To the maximum extent permitted by law, we are not liable for indirect or consequential damages, loss of profits, or loss of data arising from your use of the Platform or from any contract or relationship between Talents and Employers.
Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g., for intentional misconduct or statutory rights).

 

11. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in law, regulatory guidance, or Platform features. 

Where changes are material, we will notify you via the Platform or by email in advance where reasonably possible. Continued use of the Platform after the effective date of updated Terms constitutes your acceptance of those changes.
